Terms and Conditions

These terms apply to services provided by Ondřej Šrámek, Company ID (IČO) 21732761, registered office at Brno, Czech Republic, registered in the Czech Trade Licensing Register since 19 June 2024, not a VAT payer (referred to below as "the provider" or "I").

These terms apply in full particularly to photography services ordered by individuals acting as consumers. For analytical, consulting and lecturing work, which I generally provide to businesses and organisations, an individually agreed contract or order takes precedence; these terms apply only where that contract is silent. Where such a service is ordered by a consumer, the articles on withdrawal from the contract and on out-of-court dispute resolution apply to them as well.

How an order is made

Cooperation arises from a mutual agreement on scope, price and timing, typically by e-mail. The contract is concluded at the moment I confirm the date and scope to you, or you confirm the offer I have sent.

For photography, cooperation is conditional on a completed Model Release and agreement with the photography terms and rules, which govern delivery of images, copyright and the scope of the licence. I photograph persons over 18 years of age only; for boudoir, glamour and nude work I verify age from an identity document.

Finished images are delivered through an online gallery. A Pixin gallery stays available for 14 days from the moment it is shared, after which it is removed automatically – downloading the images within that window is your responsibility. For weddings and reportage engagements I deliver images through Zonerama, where the gallery is kept without a time limit unless we agree otherwise.

Prices and payment

Current prices are listed on the Pricing page. The prices stated are final; I am not a VAT payer. The final price may differ depending on the scope of the engagement, the number of images selected, the length of the shoot or the scope of the analysis; I always confirm it before starting work.

Payment is made against an invoice with the due date stated on it, unless agreed otherwise. For photography I may require a deposit to reserve the date.

Cancelling and rescheduling

A shoot can be rescheduled by agreement. If you cancel less than 48 hours before the agreed start, the deposit paid is forfeited – I need to arrange equipment for the date in advance (for example, borrowing a lens), and a late cancellation makes that preparation wasted. If you cancel more than 48 hours before the start, I refund the deposit in full. If I have to cancel, I will offer a replacement date or refund the deposit.

This article is without prejudice to your right to withdraw from the contract within 14 days under the following article.

Consumer's right to withdraw within 14 days

Where we concluded the contract at a distance (by e-mail, phone or form) or away from my usual business premises, you have the right as a consumer to withdraw from it within 14 days of its conclusion, without giving a reason and without penalty. Sending an e-mail to ondrej@ondrejsramek.cz is sufficient.

If you want me to start work, or to hold the shoot, before that period expires, please confirm this to me expressly by e-mail. In that case:

  • if you withdraw after I have started performing at your request, you will pay me a proportionate part of the price corresponding to the services provided up to that point,
  • if the service is fully performed before the 14-day period expires, at your express request and with your consent (the shoot took place and the images were delivered, the consultation took place, the deliverable was handed over), the right to withdraw ceases to exist (Section 1837 of the Czech Civil Code).

Withdrawal from the contract does not affect your separate right to withdraw consent to the use of your images in my portfolio at any time. You can do so regardless of the periods above, by e-mail to ondrej@ondrejsramek.cz.

Complaints

If the service delivered does not meet your expectations, write to ondrej@ondrejsramek.cz describing the defect, ideally without undue delay after you discover it. I will settle the complaint within 30 days of it being raised, unless we agree on a longer period. A resolution may take the form of further retouching, a replacement shoot, supplementing the analysis deliverable, or a reasonable discount.

Subjective dissatisfaction with a result that matches the agreed scope and the style presented in my portfolio does not constitute a defect in the service.

Out-of-court resolution of consumer disputes

If we cannot reach agreement, you have the right as a consumer to turn to the Czech Trade Inspection Authority as the body for out-of-court resolution of consumer disputes:

Personal data and confidentiality

How I handle personal data is described in the Privacy Policy.

For analytical and consulting work I undertake to keep confidential everything I learn during the engagement, including after it ends. I do not use analysis outputs or any client data for my own purposes, nor do I provide them to third parties, unless the contract with the client provides otherwise or the law requires it.

Effective date

These terms are effective from 1 September 2026 and apply to cooperation agreed after that date. The current version is always available on this page.
